This Notice explains how Infroryx Inc. collects, uses, discloses, and protects your Personal Information when you use our services, access our websites, or communicate with us.
If you use the Services on behalf of an organization, that organization may be the “controller/business” of certain data and you may need to contact your organization to exercise certain rights. Infroryx may act as a “processor/service provider” for organization-controlled data.
Scope, Controller/Processor Roles, and Other Agreements
Scope. This Notice applies to Personal Information processed by Infroryx in connection with the Services. It does not apply to third-party websites, apps, carriers, licensors, payment processors, data centers, cloud platforms, or other third parties you may access through links or integrations.
Roles. Depending on context:
- Infroryx as Controller/Business: We act as controller for Personal Information we process for our own purposes (e.g., website visitors, marketing where used, billing contacts, account administration, support operations).
- Infroryx as Processor/Service Provider: We may process Personal Information as a processor on behalf of a customer organization when providing hosted services, managed services, email hosting, telecom services, or other services where the customer determines the purposes and means of processing.
Other Agreements. If you have a separate written agreement with Infroryx (e.g., a Data Processing Addendum, enterprise addendum, or specific compliance addendum), that agreement controls where it conflicts with this Notice for the covered subject matter.
Definitions
- Personal Information / Personal Data: Information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked to an individual or household.
- Customer Content: Content and data submitted to, stored in, transmitted through, or processed using the Services by you or your users (including emails, files, voice recordings, logs, databases, messages, and similar content).
- Sensitive Personal Information: Categories treated as sensitive under certain laws (examples may include government identifiers, precise geolocation, biometric identifiers, health information, racial/ethnic origin, religious beliefs, or union membership).
- Processing: Any operation performed on Personal Information (collection, storage, use, disclosure, deletion, etc.).
- Service Providers / Processors / Subprocessors: Vendors that process Personal Information on our behalf to provide the Services.
Information We Collect
We collect Personal Information in three ways: (A) information you provide, (B) information collected automatically, and (C) information received from third parties.
- Account & Contact Data: Name, organization name, job title, email address, phone number, mailing address, usernames, account identifiers, authentication credentials, and communications preferences.
- Billing & Transaction Data: Invoices, subscription/service plan details, service history, payment status, transaction records, tax-related business identifiers, and payment confirmations. Payment card/bank details are generally handled by payment processors.
- Support & Communications: Support tickets, emails, chats, call notes, attachments, troubleshooting artifacts, and other communications with us.
- Identity/Verification Data (when required): Information used to prevent fraud, verify identity, comply with law, or provision telecom services (including porting).
- Service Configuration Data: Technical settings you submit or approve (DNS records, IP allowlists, mailbox settings, routing preferences, SIP/VoIP provisioning details, firewall/VPN configuration parameters, and similar).
- Customer Content: Data and content you or your users store, transmit, or process through the Services, such as hosted websites/databases, files, email content, logs, voice recordings, messages, and other content.
- Device & Usage Data: IP address, device identifiers, browser type, operating system, access times, pages viewed, referrer URLs, clickstream events, and interactions with the Services.
- Security & Audit Data: Authentication logs, access records, administrative actions, and security telemetry used to protect accounts and infrastructure, investigate abuse, and maintain audit trails.
- Cookies & Similar Technologies: Cookies, pixels, SDKs, local storage, and server-side tracking logs. See Section 10.
- Payment processors: payment confirmation, limited billing metadata, fraud signals.
- Carriers/telecom providers: provisioning and porting status, service metadata, compliance signals, and delivery/quality signals.
- Vendors: cloud/hosting/data center providers, security vendors, monitoring vendors, ticketing platforms.
- Licensors/rights-holders (media/IPTV, if applicable): compliance or enforcement notices.
- Partners/resellers: account and contact data needed to provide Services.
How We Use Personal Information
- Provide and operate Services (account creation, provisioning, authentication, delivery, configuration).
- Support and communications (tickets, troubleshooting, notices, service alerts).
- Billing and collections (invoicing, payment processing, fraud prevention, enforcing payment terms).
- Security and integrity (monitoring, access control, abuse prevention, incident response).
- Compliance and legal obligations (lawful requests, regulatory/carrier requirements, licensing enforcement).
- Service improvement (analytics, debugging, performance optimization, capacity planning).
- Business operations (recordkeeping, audits, dispute resolution, enforcing agreements).
- Marketing, where permitted (sending marketing emails/texts only where permitted; you can opt out as required by law).
Legal bases where required. Where laws such as GDPR/UK GDPR apply, processing is based on one or more of: contract necessity (to provide Services), legitimate interests (security, fraud prevention, improving services), legal obligations (compliance), and consent (where required for certain marketing or cookies).
How We Disclose Personal Information
We disclose Personal Information only as needed and for the purposes described above.
We share Personal Information with vendors that help us operate our business and provide Services (hosting/cloud infrastructure, data centers, ticketing, monitoring, analytics, security, communications tools, and payment processing). These vendors are contractually required to protect information and use it only for the services they provide to us.
Notwithstanding any other provision of this Notice, mobile telephone numbers collected for SMS/text messaging, and any consent or opt-in status associated with those numbers, are NOT shared with, sold to, rented to, or transferred to any third party or affiliate for marketing or promotional purposes — including but not limited to affiliated companies, advertising partners, or data brokers. This data is used solely by Infroryx Inc. to deliver service-related communications as described in Section 8.
For internet resale, VoIP, SMS/messaging, and cellular services, we may share Personal Information with carriers and telecom partners as needed to provision, support, route, comply with telecom requirements, and prevent fraud/abuse.
For IPTV/media services (where applicable), we may share information necessary to comply with licensing terms and respond to enforcement notices.
We may disclose information to comply with subpoenas, warrants, court orders, or lawful requests; to protect rights, property, and safety of Infroryx, customers, or others; to investigate fraud, security incidents, and abuse; and to enforce our agreements.
We may disclose information in connection with mergers, acquisitions, financing, reorganization, bankruptcy, or sale of assets.
We do not sell Personal Information for money in the traditional sense. Some privacy laws define “sell” or “share” broadly. If our practices are deemed to involve “sale” or “sharing” under applicable law, you may opt out as described in our Do Not Sell or Share My Personal Information page.
Sensitive Personal Information and Restricted Data
We do not intentionally collect Sensitive Personal Information except as needed for:
- Fraud prevention and security
- Compliance with law
- Telecom provisioning requirements
- Providing Services you request
Unless expressly agreed in writing, you should not provide Infroryx with: protected health information (HIPAA) requiring a BAA, PCI cardholder data beyond what payment processors handle, or special-category data requiring heightened protections in some jurisdictions.
Telecom, Email Hosting, Messaging, and Media Data
Because we provide IT and communications services, additional processing may occur:
- Email Hosting: We may process sender/recipient data, headers, anti-spam and abuse signals, and message content as needed to deliver email, filter spam/malware, maintain security, and provide support.
- VoIP/SMS/Cellular: Carriers and telecom partners may process routing/delivery metadata and apply filtering/throttling policies. Delivery is subject to carrier networks outside our control.
- Media/IPTV: Licensors may require compliance checks and may issue enforcement actions; we may process and share limited account/compliance information to meet licensing terms.
SMS/MMS Messaging — Opt-In, Opt-Out, and Data Practices
Infroryx Inc. operates an SMS/text messaging program to send service-related communications to clients, contacts, and individuals who have provided consent. Messages may include:
- Service outage and maintenance notifications
- Security alerts and account notices
- Support ticket status updates
- Provisioning and configuration confirmations
- Billing notices and payment reminders
- Two-factor authentication (2FA) codes
You may consent to receive SMS messages from Infroryx by:
- Providing your mobile number when creating an account or submitting a contact or support form and checking the applicable SMS consent box;
- Signing a service agreement or work order that includes SMS consent language; or
- Texting START to a designated Infroryx number.
By opting in, you agree to receive recurring automated and non-automated text messages from Infroryx Inc. Consent is not a condition of purchasing any service.
Message frequency varies based on your service activity and account status. You may receive multiple messages per month during active support engagements, outages, or billing cycles.
Standard message and data rates may apply depending on your mobile carrier plan. Infroryx does not charge for SMS messages, but your carrier may.
You may opt out of Infroryx SMS messages at any time by:
- Replying STOP to any Infroryx text message. You will receive one confirmation message and no further messages will be sent, except as required by law or where critical safety/security notices cannot legally be withheld.
- Emailing [email protected] with “SMS Opt-Out” in the subject line, including your mobile number.
After opting out, you may re-enroll at any time by replying START or contacting us directly.

SMS delivery is supported on all major U.S. carriers including AT&T, T-Mobile, Verizon, and others. Delivery may be delayed or affected by carrier filtering policies outside Infroryx’s control. Infroryx is not liable for delayed or undelivered messages.
Mobile opt-in information — including your mobile telephone number, consent status, and opt-in/opt-out preferences — will NOT be shared with, sold to, rented to, or disclosed to any third party or affiliate for marketing or promotional purposes. This data is used solely by Infroryx Inc. to deliver the service-related communications described in this section.
The only exceptions are:
- Sharing with our SMS platform provider and telecom carrier partners solely as necessary to transmit messages on our behalf. These vendors are contractually prohibited from using your data for their own purposes.
- Disclosures required by law or legal process.

Data Retention
We retain Personal Information for as long as reasonably necessary to:
- Provide Services
- Comply with legal obligations
- Enforce agreements
- Resolve disputes
- Maintain security and audit trails
Retention periods vary by service and data type. We may delete, de-identify, or anonymize Personal Information when it is no longer needed, subject to legal and operational requirements.
Cookies, Tracking, and Online Advertising
We use cookies and similar technologies (pixels, SDKs, local storage, server-side logs) for:
- Authentication and session management
- Security and fraud prevention
- Preferences
- Analytics and performance
- Advertising/targeting (if used)
Cookie choices: You can control cookies through browser/device settings and any cookie tools we provide. Blocking cookies may impact site functionality.
Do Not Track / GPC: Some browsers send “Do Not Track” signals; no universal standard exists. Where required, we honor applicable Global Privacy Control (GPC) signals as opt-outs for certain processing (such as targeted advertising and certain “sale/share” definitions), where applicable.
Data Security
We use reasonable administrative, technical, and physical safeguards designed to protect Personal Information. No security program can guarantee absolute security.
Security incidents: If we become aware of a security incident affecting Personal Information, we will investigate and provide notifications as required by applicable law.
International Data Transfers
We are based in the United States. If you access the Services from outside the U.S., your information may be transferred to and processed in the U.S. and other countries where we or our vendors operate. Where required, we implement appropriate safeguards for cross-border transfers.
Your Privacy Rights (U.S. States + International)
Depending on your location and applicable law, you may have rights to:
- Access/Know what Personal Information we collect, use, and disclose;
- Correct inaccurate Personal Information;
- Delete certain Personal Information (subject to exceptions);
- Port certain Personal Information (where applicable);
- Opt out of targeted advertising, certain profiling, and certain “sale/share” definitions (where applicable);
- Withdraw consent where processing is based on consent; and
- Appeal decisions on rights requests where required by state law.
How to exercise rights: Email [email protected] with subject line: “Privacy Request”. We may verify identity and authority. If you are an end user of a business customer, we may refer your request to your organization’s administrator.
Authorized agents: Where legally permitted, authorized agents may submit requests on your behalf, subject to verification and proof of authorization.
Exceptions: We may deny or limit requests where permitted by law, including when necessary to provide Services, comply with legal obligations, protect security and prevent fraud/abuse, maintain records for billing/disputes, and exercise or defend legal claims.
California and Other State-Specific Information
Some U.S. states (including California and Colorado) require additional disclosures and opt-out rights in certain circumstances (such as targeted advertising or broad “sale/share” definitions). If those laws apply to our processing, we provide opt-out mechanisms through our Do Not Sell or Share My Personal Information page and honor applicable universal opt-out mechanisms (like GPC) where required.
Children’s Privacy
Our Services are not directed to children under 13, and we do not knowingly collect Personal Information from children under 13. If you believe a child has provided Personal Information, contact [email protected].
Law Enforcement, Licensing, and Abuse Prevention
We may preserve and disclose information and records to:
- Comply with subpoenas, warrants, court orders, or lawful requests;
- Protect the rights, property, or safety of Infroryx, our customers, or others;
- Investigate and mitigate fraud, abuse, security incidents, and licensing violations.
Third-Party Links and Services
Our Services may link to or integrate with third-party services. Their privacy practices are governed by their own policies, not this Notice.
Changes to This Privacy Notice
We may update this Notice from time to time. The “Last Updated” date indicates when it was most recently revised. Material changes will be posted on our website and/or delivered through the Services where appropriate.
